complete.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (§ 13 BGB).

Section 2 – Conclusion of Contract

  1. The presentation of the products in the online shop does not yet constitute a binding offer to conclude a purchase agreement, but rather an invitation to the customer to place an order.
  2. The customer can place the desired products in the shopping cart and check and correct their entries before submitting the order.
  3. By clicking the order button, which clearly triggers the obligation to pay, the customer submits a binding offer to conclude a contract for the goods contained in the shopping cart.
  4. The customer receives electronic confirmation of their order. A contract is formed when PMC-Design expressly accepts the order, sends an order confirmation, or ships the ordered goods. An email sent immediately after the order merely confirming receipt of the order does not yet constitute acceptance.
  5. For payment methods where the payment process is initiated immediately after the order is placed, the contract can be concluded upon completion of the payment process, provided this is indicated accordingly in the ordering process.

Section 3 – Contract text and contract language

  1. The contract language is German.
  2. PMC-Design stores order data in accordance with legal retention requirements.
  3. The customer receives the information relevant to the contract, including these terms and conditions, on a durable medium, in particular by email.
  4. If a customer account is offered and used, past orders can be viewed there.

§ 4 – Prices and shipping costs

  1. All prices quoted to consumers in the online shop are total prices and include statutory VAT.
  2. Any additional delivery and shipping costs will be displayed to the customer before they submit their binding order.
  3. For goods that, due to their nature, cannot be sent via normal postal service, the applicable delivery costs will be indicated before the conclusion of the contract.

§ 5 – Payment Terms

  1. The customer has the payment options displayed during the respective ordering process available.
  2. In the case of payment in advance, the invoice amount is due for payment after conclusion of the contract.
  3. When using a payment service provider, its payment terms also apply.

§ 6 – Delivery and delivery time

  1. The available delivery options and the expected delivery time are indicated with the respective product or during the ordering process.
  2. In the case of payment in advance, the stated delivery period generally begins after receipt of payment, unless otherwise stated.
  3. PMC-Design is only entitled to make partial deliveries if this is reasonable for the consumer. The consumer will not incur any additional shipping costs as a result, unless these have been expressly agreed upon beforehand.

Section 7 – Transfer of Risk

In the case of consumers, the risk of accidental loss or accidental damage to the goods generally only passes to the consumer upon delivery of the goods to the consumer or a third party designated by him or her as the recipient.

The special legal regulations remain unaffected.

§ 8 – Retention of Title

The delivered goods remain the property of PMC-Design until the purchase price has been paid in full.

Section 9 – Right of withdrawal

Consumers generally have a statutory right of withdrawal in the case of distance contracts.

PMC-Design provides information about the conditions, deadline, procedure and consequences of cancellation in a separate cancellation policy.

§ 10 – Custom-made goods

  1. In particular, there is no statutory right of withdrawal for contracts concerning the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, provided that the legal requirements of Section 312g Paragraph 2 No. 1 of the German Civil Code (BGB) are met.
  2. This can include, for example, products manufactured specifically according to customer drawings, individual dimensions, customer-specific designs, or a special configuration specified by the customer.
  3. The mere fact that a product is manufactured only after an order has been received does not in itself lead to the exclusion of the right of withdrawal.
  4. If, due to its individual design, there is no right of withdrawal for a product, the consumer will be informed of this before placing their order in accordance with legal requirements.

§ 11 – Data provided by the customer for custom-made products

  1. For products manufactured according to drawings, dimensions, CAD files or other individual specifications provided by the customer, the customer is responsible for the accuracy and completeness of their specifications.
  2. PMC-Design is not obliged to check the technical documents provided by the customer for design or technical suitability, unless such a check has been expressly agreed upon.
  3. The consumer's statutory rights regarding defects caused by PMC-Design remain unaffected.

§ 12 – Warranty and rights in case of defects

The statutory warranty rights apply.

Consumers are requested to report any obvious transport damage to the delivery person as soon as possible and to inform PMC-Design. Failure to report such damage does not affect the consumer's statutory rights.

§ 13 – Liability

  1. PMC-Design is liable without limitation for damages resulting from intentional and grossly negligent breaches of duty.
  2. PMC-Design is liable without limitation for damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty by PMC-Design or one of its legal representatives or agents.
  3. In cases of slight negligence resulting in a breach of a material contractual obligation, PMC-Design is liable for damages typical for this type of contract and foreseeable at the time of its conclusion. Material contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the consumer may regularly rely.
  4. Furthermore, liability for damages caused by slight negligence is excluded to the extent permitted by law.
  5. The foregoing limitations of liability do not apply in the case of fraudulent concealment of a defect, in the case of the assumption of a guarantee, as well as for claims under the Product Liability Act or on the basis of other mandatory statutory liability provisions.

§ 14 – Applicable Law

The law of the Federal Republic of Germany applies.

For consumers, this choice of law only applies to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence.

§ 15 – Final Provisions

Should individual provisions of these General Terms and Conditions be or become wholly or partially invalid, the statutory provisions and the validity of the remaining provisions shall remain unaffected.
